Your Rights Under the Insurance Act

In Canada, auto insurance policies are governed by provincial Insurance Acts. Most standard policies contain a mandatory provision known as Statutory Conditions.

Statutory Condition 11 (Appraisal) gives you the right to dispute the insurance company's valuation of your total loss vehicle. If you and the insurer cannot agree on the Actual Cash Value, you can demand an appraisal.
